RiskAssessments.ai provides an AI-powered platform for generating risk assessments. The Service uses artificial intelligence to identify potential risks based on information you provide. However, you acknowledge and agree that:

• The AI-generated risk assessments are suggestions and require your review, approval, and customisation
• You are solely responsible for the final content and accuracy of any risk assessment you create
• The Service is a tool to assist with risk assessment processes, not a replacement for professional judgement
• We make no warranties about the completeness, accuracy, or suitability of any AI-generated content

3. User Responsibilities

You agree to:

• Provide accurate and complete information when using the Service
• Review and verify all AI-generated content before using it
• Maintain the security and confidentiality of your account credentials
• Not use the Service for any unlawful or prohibited purpose
• Not attempt to circumvent any limitations or restrictions on the Service
• Not reverse engineer, decompile, or attempt to extract source code from the Service

4. Professional Responsibility

Risk assessments are critical safety documents that require professional judgement and expertise. By using this Service, you acknowledge that:

• You have the necessary competence and authority to conduct risk assessments in your context
• You will apply appropriate professional standards and comply with all applicable laws and regulations
• The final risk assessment is your work product and you accept full responsibility for its content and use
• We are not responsible for any consequences arising from your use of AI-generated content

5. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees as described at the time of purchase
• Provide accurate billing information and keep it up to date
• Authorize us to charge your payment method on a recurring basis until you cancel

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not provide refunds for partial subscription periods.

6. Intellectual Property

The Service, including its software, design, text, graphics, and other content (excluding user-generated content), is owned by RiskAssessments.ai and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the content you create using the Service, including your final risk assessments. We do not claim ownership of your content and do not store or reuse it after delivery (see our Privacy Policy for details).

7. Limitation of Liability

To the fullest extent permitted by law, RiskAssessments.ai and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Service
• Any errors, mistakes, or inaccuracies in AI-generated content
• Any injury, property damage, or other harm resulting from your use of risk assessments created with the Service
• Any unauthorised access to or use of our servers and/or any personal information stored therein

In no event shall our total liability to you for all claims exceed the amount paid by you, if any, for accessing the Service during the twelve (12) months prior to the claim.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

9. Indemnification

You agree to indemnify, defend, and hold harmless RiskAssessments.ai and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
